1. Acceptance of Terms
By accessing or using the Orch8.io website, APIs, SDKs, documentation, and related services (collectively, the "Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the Service.
2. Description of Service
Orch8.io provides a self-hosted workflow orchestration engine distributed as a binary and Docker image. The Service includes the engine software, client SDKs, documentation, and the orch8.io website.
3. Eligibility
You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use the Service. By using the Service, you represent and warrant that you meet these requirements.
4. Account and Access
Certain features of the Service may require you to register for early access or create an account. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law
- Reverse engineer, decompile, or disassemble the Service except as permitted by law
- Interfere with or disrupt the integrity or performance of the Service
- Attempt to gain unauthorized access to the Service or its related systems
- Use the Service to send spam, malware, or other harmful content
- Redistribute, sublicense, or resell the Service without prior written consent
6. Intellectual Property
The Service, including its source code, documentation, design, and branding, is owned by Orch8.io and protected by intellectual property laws. Your use of the Service does not grant you ownership of any intellectual property rights in the Service. You retain ownership of any data you process through the self-hosted engine.
7. Licensing
The Orch8 engine is provided under a commercial license. The specific terms of the software license, including permitted uses, restrictions, and redistribution rights, are governed by the license agreement accompanying the software distribution. Early access participants receive a limited evaluation license.
8. Data and Self-Hosting
Orch8 is designed to be self-hosted. When you deploy the engine on your own infrastructure, you are solely responsible for the data processed by the engine, including compliance with applicable data protection laws. Orch8.io does not access, collect, or store data processed by self-hosted instances of the engine.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ORCH8.IO DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ORCH8.IO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SERVICE.
11. Indemnification
You agree to indemnify and hold harmless Orch8.io and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service or violation of these Terms.
12. Modifications
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the website with a new "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
13. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Sections 6, 9, 10, and 11 survive termination.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the Federative Republic of Brazil. Any disputes arising from these Terms shall be submitted to the competent courts of Brazil.
